ADA, FMLA and Pregnant Workers Fairness Act - 01/08/2025
Since the Pregnant Workers Fairness Act went into effect in June, its heightened accommodation requirements have been strictly enforced by the EEOC. Given that the PWFA is part of the EEOC’s Strategic Enforcement Plan, investigators have been extraordinarily aggressive in pursuing these charges. The EEOC has also filed several lawsuits under the PWFA, asserting that the employer(s) failed to accommodate an employee’s pregnancy related limitations.
In this webinar, attendees will learn about the heightened requirements of the PWFA and how they compare to the Americans with Disabilities Act and the Family Medical Leave Act. We will discuss differences in the interactive processes, appropriate/necessary documentation, the nature and duration of “reasonable” accommodations, and the difficulty in demonstrating undue hardship to the employer. We will also discuss common themes in dealing with EEOC litigation and investigations into charges of discrimination asserting claims under the PWFA.
